                              ORDINANCE NO.   9858 
                  
                  
                   AN ORDINANCE ABANDONING A SEWER EASEMENT,
                   RELOCATION OF A SEWER LINE AND THE
                   ACCEPTANCE OF A NEW 15 FOOT WIDE SEWER
                   EASEMENT, TOGETHER WITH THE ABANDONMENT OF
                   EXISTING MANHOLES AND THE RELOCATION AND
                   ACCEPTANCE OF NEW MANHOLES WITHIN BONNY OAKS
                   INDUSTRIAL PARK, ENTERPRISE PARK DRIVE, LOT
                   25, PLAT BOOK 47, PAGE 261, R.O.H.C.

              	   WHEREAS, the Chattanooga City Engineer's Office has
         requested the abandonment of an existing sewer easement for Lot 

         25, Bonny Oaks Industrial Park site as shown on the attached
         map and the acceptance of a new sewer easement and manholes; 
and
              	   WHEREAS, pursuant to the requirements of the Tennessee 

         Code Annotated, the Chattanooga-Hamilton County Regional
         Planning Commission has reviewed the proposed abandonment and
         acceptance and has recommended approval of same; and
              	   WHEREAS, the property owner will fill the existing
         manhole and install the new sewer line including the placement
         of new manholes to the standards established by the Department
         of Public Works and said line and manholes will be inspected by 

         the City of Chattanooga inspectors prior to acceptance thereof; 

         and
              	   WHEREAS, the owner will maintain the existing service
         to the existing sewer line, for the benefit of lot 26 of the
         referenced plat, until such time as the new sewer line is
         serviceable to that lot.
                                 NOW, THEREFORE,
              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, that the portion of an existing 

         sewer easement for Lot 25, Bonny Oaks Industrial Park site 
shown
         on the attached map be and is hereby abandoned subject to the
         provisions of Sections 2 and 3 below.
              	   SECTION 2.  BE IT FURTHER ORDAINED that the Mayor is
         authorized to execute all documents necessary to complete this
         abandonment and acceptance upon notice from the Department of
         Public Works that the replacement sewer line and manholes have
         been accepted.
              	   SECTION 3.  BE IT FURTHER ORDAINED that this Ordinance 

         shall take effect two weeks from and after its passage as
         provided by law, provided that this Ordinance shall not be
         operative until approval and acceptance of the replacement 
sewer
         line, sewer easement and manholes.
